SUBJECT OF THE REGULATIONS

The regulations define the rules, scope and conditions for participation in online language classes conducted by the Hiperkursy Paulina Piasecka language school.

 

DEFINITIONS

The terms used in the Regulations have the following definition:

  1. Organizator  - Paulina Piasecka, running a business under the name HIPERkursy Paulina Piasecka, ul. Aleksandry Gabrysiak 42/26, 80-175 Gdańsk, NIP: 9571119549, REGON: 384659997

  2. Kursant  - person participating in the course.

  3. Offer - current course packages available on the Organiser's website: https://www.hiperkursy.pl/

  4. Online course  - a service provided by the Organizer by electronic means via a videoconference platform, in particular: Whereby, Zoom, Google Meet, Skype, Teams, Messenger, including a series of language classes on the subject and duration specified in the Offer or agreed individually with the course participant.

  5. Student's Panel  – an ICT system as defined by the Act of 18 July 2002 on the provision of electronic services through which the Course is provided, belonging to: Langlion.com, on which the Organizer provides teaching materials.

  6. Agreement   - an agreement for the provision of services within the meaning of the provisions of the Act of 23 April 1964 Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended), concluded by the Organizer with the Student, performed by means of distance communication, including e-mail, Messenger, text messages and forms.

  7. Parties   - parties to the Agreement, ie the Organizer and the Student.

  8. Civil Code   - Act of 23 April 1964 Civil Code (i.e. Journal of Laws of 2016, item 380, as amended) ._ cc781905-5cde-3194-bb3b -136bad5cf58d_

 

  1. ORGANIZATION OF COURSES

 

  1. The Organizer conducts individual or group online foreign language courses in regular or intensive mode, throughout the calendar year, in accordance with the current Offer available on the Organizer's website: https://www.hiperkursy.pl/oferta .

  2. Registration for the course takes place by completing the form available on the Organiser's website and paying the cost of the course within the prescribed period, after prior arrangement of the schedule and conditions with the Organizer.

  3. If there are not enough places in the group, the order of payment is decisive for participation in the course.   Confirmation of participation in the course will be sent to the student by e-mail . 

  4. The student, depending on the selected online course, receives an individual login or password to the Student's Panel or to the group created for the online course.

  5. A student who uses the Organizer's services for the first time has the right to participate in a free lesson or a conversation with the teacher, within the time limit agreed with the Organizer.  

  6. On public holidays, classes may take place if the whole group agrees. There will be no classes during Christmas and Easter . 

  7. The date of the course is determined by individual arrangements or in groups before the start of the first class. The organizer reserves the right to make changes to the timetable after the start of the language course .

2. TEACHING MATERIALS

 

  1. The organizer provides the necessary didactic materials free of charge. Teaching materials are made available for the students' own use and may not be transferred to third parties.  

  2. If the course is implemented with the use of additional didactic materials, the Student undertakes to purchase them, in particular the textbook indicated by the teacher. The price of the textbook is not included in the course price.

 

3. ALLOCATION TO A GROUP

 

  1. The Organizer conducts an online course in groups of 2 to 8 people, depending on the selected online course and on the terms specified in the Offer.

  2. Participants are allocated to groups on the basis of a diagnostic test sent by e-mail or an interview with the teacher checking the participant's skills in a foreign language.

  3. The trainee may notify the Organizer of a willingness to transfer to another group, corresponding to his / her skills, no later than on the day of the commencement of the next classes. The possibility of transferring the Student depends on the availability of places in the target group . 

  4. In the event of a group change, the Organizer will not refund the difference in the fee for the course.

  5. In the event of a reduction in the size of the group to less than 4 people, the Organizer, at its discretion, may:

    1. reduce the duration of classes to a maximum of 60 minutes,

    2. combine groups with a similar language level, provided that the number of people from the combined groups will not exceed 8,

    3. propose a different online course, available in the Offer.

 

 

4. COURSE PRICE

 

  1. The price of online language courses is available in the current Price List on the Organiser's website. The organizer stipulates that the condition for participation in the online course is the payment of the course fee within the prescribed period.

  2. The price of the course includes the fee for the agreed number of classes in accordance with the Offer, additional teaching materials that the student receives during the classes, and a certificate of completion of the course.

  1. The course fees may be paid in installments or in one-off payment in advance. The amount and number of installments depends on the type of online course, in accordance with the current Offer.

  2. Payments can be made from the Student's Panel or by bank transfer to the account number: HIPERkursy Paulina Piasecka PL75 1140 2004 0000 3902 7931 9190, SWIFT / BIC mBank: BREXPLPWMBK. The title should include the foreign language provided during registration. After making the transfer, please send the payment confirmation to the e-mail address: customer @ hiperkursy.pl .

  3. A student joining the group during the course, pays the fee for the classes taking place from the date of joining the group. The student does not pay for the classes that took place before joining the group.

  4. In the event of late payment of fees, the Organizer is entitled to charge statutory interest for the delay.

  5. Participants can take advantage of discounts established by the Organizer. Discounts do not add up. Detailed information on discounts and the method of their calculation is available on the Organiser's website.

  6. Absence or technical problems in the classroom do not constitute grounds for a reduction in course fees or a refund.

 

5. TEACHERS

 

  1. The organizer declares that the courses are run by teachers who have the necessary qualifications to teach foreign languages.

  2. The organizer reserves the right to change the teacher conducting classes with a given group during the course for technical and organizational reasons or other reasons beyond the control of the Organizer.

 

6. CANCELLATION OF CLASSES

 

  1. The organizer reserves the right to cancel classes in exceptional circumstances. If the classes are canceled by the Organizer, the classes will be conducted on the date agreed with the group members . 

  2. A student taking an individual course may cancel classes no later than 6:00 p.m. on the working day preceding the classes. Appeals should be reported directly to the teacher conducting the language course or to the Organizer. Classes canceled on the day they are held are considered completed.

  3. In the event of failure to report or failure to meet the deadline for reporting the inability to participate in the classes organized by the Organizer, the classes take place in accordance with their schedule and the participant may not repeat these classes.

  4. In the case of group courses, the possibility of changing the date of classes depends on the written consent of all Students in a given group, and the group reports such a need one day before the scheduled date. The date of overdue classes should be agreed with the Organizer, not later than by the commencement of the next classes.

  5. It is not possible to take overdue lessons as a continuation or extension of the course.

 

7. TERMINATION OF THE CONTRACT AND COMPLAINTS

  1. The trainee has the right to terminate the Agreement with one month's notice, effective at the end of the month, by submitting  officials by e-mail or  sent to the Organiser's address by registered mail in the case when the reason for the termination of the contract is a change in life situation or a sudden random event causing psychophysical indisposition, or a long-term illness preventing participation in classes. The student is obliged to confirm the indicated circumstances with written documents.

  2. The student has the right to submit a complaint in writing to the e-mail address client @ hiperkursy.pl or by registered mail to the address of the Organizer, ul. Aleksandry Gabrysiak 42/26, 80-175 Gdańsk. 

  3. The organizer replies to statements and complaints within 14 calendar days from the date of its receipt.

  4. In the event of termination of the contract, subject to paragraph 2, the Organizer will reimburse the Student for the fees paid by the Student, reduced by the amounts for lessons remaining until the end of the course, with a deduction of 30% of the course price without any discounts.

  5. The Organizer reserves the right to terminate the Agreement in the event of a gross breach of the Agreement or other behavior of the Participant that could threaten the interests of other Students.

  6. The Organizer may terminate the Agreement if the installments are not settled in two months.

  7. In the event of termination of the Agreement by the Organizer due to the occurrence of the conditions described in paragraph 4-5, the Organizer may keep the fees already paid.

  8. If there are no places in the group or there are not enough people to set up the course, after 30 days from signing the contract with the Student, the Parties may terminate the Agreement with immediate effect, and the Student is entitled to a refund of the funds paid in full. The refund will be processed within 14 days.

 

8. ONLINE LESSON PREPARATION

 

  1. The trainee is obliged to adapt the computer equipment to participate in the classes, in particular, he is obliged to ensure an efficient and stable Internet connection and provide adequate infrastructure and space for the online course, and in the event of any interference or noise during the classes, he is obliged to mute the microphone.

  2. In the event of technical problems, the trainee has the option to consult a technical support employee. The student is obliged to follow the recommendations of the technical support. The organizer reserves that in the event of a request for already clarified technical issues, the answer to a similar question will not be given . 

  3. The student is not entitled to a refund for the student's absence from the classes due to technical problems. The organizer is not responsible for technical problems on the part of the student.

  4. Online classes can be recorded if all students and the teacher agree to it, and the recorded lessons will not be disseminated. The student acknowledges that recording classes without the consent of the Organizer and other course participants may result in legal liability.

 

10. RECEIVING CERTIFICATE OF PARTICIPATION

  1. The organizer undertakes to issue a certificate of completion of the language course if the absence during the course did not exceed half of the number of classes specified in the Organizer's Offer.

  2. If the Student's absence exceeds half of the number of classes during the course, the Organizer reserves the right to refuse to issue a certificate of participation in the course.

  3. The certificate is issued in electronic form and sent to the Student's e-mail address within 14 days.

11. FINAL PROVISIONS

  1. Individual provisions take precedence over the provisions of the Regulations . 

  2. In matters not covered by the provisions of these Regulations, the relevant provisions of the Civil Code shall apply.

  3. The organizer reserves the right to change the Regulations and undertakes to inform its users about it.

  4. The condition for participation in the course is prior written confirmation of reading the Regulations.
